Andrew Smith Quoted in Wealth Management on Legal Battle Over John Amos’s Estate
Andrew Smith recently spoke to Wealth Management’s Anna Sulkin Stern about the legal battle brewing between John Amos’s daughter Shannon and son Kelly Christopher (K.C.) over the late actor’s estate. In a recent lawsuit filed after their father died last year, Shannon has accused K.C. of elder abuse, fraud, and wrongful death.
While Amos’s soundness of mind was debated near the end of his life, he allegedly disputed his daughter’s claims of elder abuse before his death. However, Andrew explained that filing the lawsuit after her father’s death could strengthen and weaken Shannon’s argument in different ways.
“In some ways, it becomes easier to bring an elder abuse case once the elder has passed away, as the list of people who have standing to file an elder abuse action grows after the elder’s death,” Andrew told Wealth Management. “However, it obviously becomes more difficult to prove abuse that is no longer taking place, due to the elder’s death.”
Andrew added that Shannon will still be able to use any documents in her possession as evidence to aid her claims of abuse.
“Mr. Amos’s daughter can still use medical records, documentary evidence (including any reports made to Adult Protective Services), financial records, and witness testimony to prove the alleged abuse,” he said.
