Rochelle Schultz Discusses Recently Discovered Will of Former Zappos CEO Tony Hsieh in Wealth Management
Rochelle Schultz recently spoke to Wealth Management about the late Zappos CEO Tony Hsieh’s will, which was mysteriously discovered more than four years after his death. The will includes a no-contest clause directed at both of Hsieh’s parents and his two brothers, outlining that they will receive nothing should they dispute any element of the will.
Rochelle explains that although no-contest clauses are enforceable, this may not be the case if a beneficiary reasonably questions the validity of the will.
“A no-contest clause may not be enforced against a beneficiary who tries to invalidate the will, if based on the facts and circumstances, the beneficiary reasonably believed that the will was invalid,” Rochelle tells Wealth Management.
Rochelle continues that despite the unusual circumstances of this will, evidence could be used to showcase its validity at the hearing, which is scheduled for May 1.
“Assuming that Tony’s will is valid, the Probate Court will determine how best to effectuate the terms of his will based on his wishes. Under certain circumstances, evidence may be used to show Tony’s intentions and clarify the terms of his will,” she concludes.
